These Terms of Service (“Terms”) govern your access to and use of the websites, applications, and related services (collectively, the “Service”) operated by Fomioo (“we”, “us”, or “our”). By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

1. The Service

Fomioo provides tools for home-based food businesses to share menus, receive and manage orders, plan preparation, and coordinate logistics. We may update, modify, or discontinue features with reasonable notice where practicable.

2. Accounts and eligibility

You must provide accurate registration information and keep your credentials secure. You are responsible for activity under your account. You must comply with applicable food-safety, licensing, tax, and consumer-protection laws in your jurisdiction. The Service does not replace professional legal, accounting, or food-safety advice.

3. Acceptable use

You agree not to:

  • use the Service for unlawful, fraudulent, or misleading purposes;
  • attempt to gain unauthorized access to our systems or other users’ data;
  • interfere with or disrupt the Service or third-party integrations;
  • upload malware or content that infringes others’ rights;
  • scrape, harvest, or automate access beyond what we expressly permit.

4. Customer and third-party interactions

You are solely responsible for your relationship with your customers, including pricing, allergens, delivery, refunds, and disputes. Messaging or delivery integrations may be subject to third-party terms; we are not responsible for outages or actions of those providers.

5. Intellectual property

We retain all rights in the Service, branding, and software. You retain rights in your own content (for example, menu text and images you upload). You grant us a limited licence to host, process, and display your content as needed to operate the Service.

6. Disclaimer of warranties

The Service is provided “as is” and “as available” to the fullest extent permitted by law. We disclaim implied warranties of merchantability, fitness for a particular purpose, and non-infringement where disclaimers are allowed.

7. Limitation of liability

To the maximum extent permitted by law, we will not be liable for any indirect, incidental, special, consequential, or exemplary damages, or for loss of profits, goodwill, or data, arising from your use of the Service. Our aggregate liability for any claim relating to the Service will not exceed the amounts you paid us for the Service in the twelve (12) months before the claim, or one hundred (100) currency units if you have not paid fees, unless a higher minimum applies under mandatory law.

8. Termination

You may stop using the Service at any time. We may suspend or terminate access for breach of these Terms or where required for legal or security reasons. Provisions that by their nature should survive will survive termination.

9. Changes

We may revise these Terms from time to time. We will post the updated version and update the “Last updated” date. Continued use after changes constitutes acceptance where permitted by law.
